2.27.01 Consulting by Executive Officers Purpose
  The University recognizes that consulting activity is valuable as a form of community service, as a form of professional development for executive officers, and as an enhancement of the University's reputation and standing Consulting by executive officers authorized under this policy should advance these purposes. Definitions
  Executive officers are defined as the vice presidents, deans, associate deans, secretary to the Board of Governors, and directors. This statute will, in addition, apply to such other officers as the president may specify by executive order. Business week is defined as Monday through Friday, excepting days on which the University is closed. Consulting is defined as (1) activity for which a person is remunerated in cash, goods, services, or otherwise, or (2) activity, whether or not involving remuneration, on behalf of any person or organization other than the University which occurs during the ordinary business hours of the University, except where such activity is part of the assigned duties of an executive officer. Reporting and Approval
  Prior to engaging in consulting, an executive officer shall fully report the proposed consulting to the University through his/her immediate superior. The approval of the President is a prerequisite for such proposed consulting. An executive officer shall not spend more than one business day (eight hours) in any business week engaged in consulting activity. In total, no executive officer's consulting activity should exceed l8 days per year. If an executive officer engages in consulting activity for more than one business day in any week, he or she shall use vacation time for the consulting activity in excess of one business day (eight hours). The president may make exceptions to these limitations on consulting activity when the University is the primary beneficiary of an executive officer's consulting, as provided by the purpose of this policy. It is the intention of this statute that the president will waive the limitations on consulting activity, but not the requirements for reporting such activity, in the case of professional service which carries only a nominal stipend and meets the other purposes and requirements of this statute. Lectures and other public appearances, service on accreditation, program review teams or site visits, membership on foundation and public agency boards or grant review panels, and similar nominally-compensated activities fall within this category of professional service. It is the intention of this statute that the limitations on consulting activity, but not the requirements for reporting such activity, may be waived by the president when an executive officer engages in such activity 1 under a practice plan approved by the University. An executive officer shall not, without reimbursement to the University, utilize University resources in consulting activities to an extent exceeding that which normally would be made available to the general public. Once each year, on a date specified by the president, executive officers shall file a summary report of the scope and extent of their consulting activities. The president shall prescribe such forms as may be appropriate for the reporting and approval of consulting activity as set forth in this policy. Performance of Duties
  Notwithstanding any authorization of consulting activity under this policy, an executive officer is expected fully to carry out the duties of his/her office. Consulting must be secondary and must not in any way adversely affect the performance of an officer's duties to the University. Conflict of Interest
  Consulting by executive officers must entail no conflict of interest. Application to the President
  The provisions of this statute apply fully to the president, except that the chairman of the Board of Governors shall, in the case of presidential consulting activities, perform the duties otherwise assigned by this statute to the president. Implementation
  The president is delegated full authority to implement this statute. He/she may delegate to other officers of the University his/her duties under this statute, except that no University officer shall be authorized to act on his/her own consulting activities by reason of such delegation.
